Collectors in NZ are bound by the Fair Trading Act. They cannot harass, threaten, or mislead you.
Harassment Rules
Misleading conduct or deceptive tactics are illegal. This includes claiming they have powers they don't, or pretending to be from a court or government agency.
Entry Into Home
Debt collectors generally **cannot** force their way into your home or garage. Unless your credit contract explicitly grants them entry (very rare), they must be invited in.
Contact Timing
Contact must be at reasonable times. Frequent or excessive calls, especially during unsociable hours, may be considered harassment.
- • Generally between 8 AM and 9 PM.
- • Contacting your family or employer is restricted.

You have the right to request written confirmation of the debt, including the original amount and any interest or fees added.

Debt Collection and the Fair Trading Act
In New Zealand, the **Fair Trading Act 1986** ensures that businesses do not engage in unfair practices. This applies to debt collectors just as much as retail stores. If a debt collector is harassing you, the Commerce Commission has the power to intervene.
What to do if a collector visits
- Do not let them inside unless you want to.
- Ask for identification and the name of the agency.
- Request that all further communication be in writing (email/post).
- If they refuse to leave, inform them they are trespassing and call the police.
