Leave at 4 if not in contract
Note: In NZ, remaining annual leave (holiday pay) must also be paid out in full (8% of gross earnings).
The "Shadow" Redundancy Pay
While not legally required, بسیاری of NZ companies offer **redundancy compensation** (e.g. 4+2 weeks) to ensure the employee signs a "Record of Settlement". This prevents future legal claims and is considered best practice.
New Zealand Workplace FAQ
Is redundancy pay mandatory in NZ?
Unlike the UK or Australia, New Zealand has no statutory redundancy pay. You are only entitled to pay if it is explicitly written in your Employment Agreement.
What is a 'Reasonable' notice period?
If your contract is silent on notice, 'reasonable notice' applies. In NZ, this is typically 4 weeks for professional roles, but can vary based on your seniority and how long you've been there.
What is Procedural Fairness?
In NZ, the REASON for redundancy must be genuine, AND the process must be fair. This includes a consultation period, considering alternatives (like redeployment), and giving you a chance to comment on the proposal.
Can I challenge a redundancy?
Yes. If the process was flawed or the reason wasn't genuine, you can file a Personal Grievance (PG) for unjustified dismissal within 90 days.
