Understanding Criminal Legal Aid

Criminal Legal Aid is a government fund that pays for legal advice and representation for people suspected or charged with a crime. It is administered by the Legal Aid Agency (LAA).

Is Legal Aid completely free?

In the Magistrates Court, yes. In the Crown Court, you may have to pay a monthly contribution if your disposable income is above a certain threshold, or pay from your capital if convicted.

Can I choose my own solicitor?

Yes. You do not have to use the Duty Solicitor. You can ask for a specific firm (e.g., "I want Smith & Co Solicitors"). As long as they have a Legal Aid contract, it is still free.

Does my partner's income count?

Yes. Legal Aid involves a household means test. Your partner's income will be included unless they are the victim/complaintant in the case.
